The bills (HB 2098 and SB 5930) were introduced two weeks ago by Governor Gregoire. The Governors proposal would ask the Health Care Authority to design a health insurance connector through which coverage could be bought and sold efficiently. It also asks the Office of the Insurance Commissioner to prepare recommendations to reduce administrative costs. The measure keeps the work of the Blue Ribbon Commission as a top priority for legislators for the 1007 session. Some legislators have expressed frustration that much of the Governors plan calls for additional study and planning of the operational aspects of the BRCs recommendations. Rep. Eileen Cody, for example, appears ready to implement substantive structural changes now, rather than waiting for additional studies and recommendations. On Monday, February 19, for example, Rep. Cody moved an amended version of HB 2098 out of her committee with a do pass recommendation. Among the amendments that were included was to delete the study of a connector design by the Health Care Authority. Informal indications suggest that she is evaluating whether legislative leaders would be willing to consider the passage of an actual connector plan through which all small group coverage would be purchased. To date, top Democratic leaders in the House and Senate have been skeptical of plans that would do more than study connector proposals at this time. HB 2098 has been referred to the House Appropriations Committee where it is scheduled for hearing on Tuesday, February 27 at 3:30 p.m. The Senate version of the Governors BRC proposalSB 5930continues to contain a study of the connector by the HCA. The bill was approved by the Senate Health & Long Term Care Committee on Wednesday, February 21. The measure has been referred to the Senate Ways and Means Committee where it will be considered on Wednesday, February 28. The business community, health plans, health underwriters, and others provided testimony in support of the general direction of the Governors BRC proposalparticularly those aspects of the proposal that call for a thoughtful study of the operational aspects of the recommendations before structural changes are actually made. House Committee Approves Amended Version of OIC Producer Licensing Bill Senate Committee Likely to Bring Senate Version to Vote Shortly The House Insurance, Financial Services & Consumer Protection Committee has given approval to an amended version of HB 1533legislation that the OIC has introduced to reform and modernize agent, broker, and adjuster licensing and administration. The proposal is intended to simplify and streamline the licensing process in an effort to provide reciprocity and uniformity with other states insurance licensing laws. The bill moved forward shortly after an agreement was reached relating to an amendment regarding the disclosure of producer compensation. The Senate Financial Institutions & Insurance Committee will likely bring its version of the billSB 5715to a vote on Tuesday, February 27. Senate Committee Considers Costly Any Willing Pharmacy Proposal The Senate Health & Long Term Care Committee held hearings on Monday, February 19 and Wednesday, February 21 to consider SB 5605a measure introduced at the request of a number of pharmacy groups that would require health plans and managed pharmacy benefits programs to allow all pharmacies to participate in providing pharmacy benefits if they are willing to accept the contracted price. The Washington Health Care Authority provided a fiscal note estimating that the bill would add $8.6 million to the cost of providing pharmacy benefits to state employees and beneficiaries in the remainder of the current biennium, and $11.5 million in additional costs for the next biennium. Health plans and employer groups also expressed opposition to the measurearguing that any willing provider requirements dilute the ability to achieve price savings by moving patient volume to contracted providers. The bill has not been scheduled for a vote. The House version of the bill has not even been provided with a hearing. Senate Committee Considers Retainer Health Care Practice Bills The Senate Health & Long Term Care Committee has held two hearings to consider bills relating to so-called retainer health care practices. Insurance Commissioner Mike Kreidler introduced SB 5716 to address the regulatory issues of concern to the OIC. The OIC believes that retainer practices constitute the transaction of insurance, and must either receive a regulatory safe harbor or be subject to full regulation as a health carrier. Under SB 5716 the OIC would maintain limited regulatory oversight with respect to retainer practice agreements, including the development of rules and standard disclosure forms. Retainer practices would be defined and specifically exempted from most insurance laws and regulations. The bill was opposed by virtually all groups, including health plans, the Washington State Medical Association, the Senior Lobby, and others. A related, but separate billSB 5958was introduced by Senator Karen Keiser (D, Kent). Under the measure retainer practice arrangements would be explicitly exempted from insurance laws. A partial hearing on the measure was held on Thursday, February 22, with a concluding hearing to be held on Monday, February 26. Controversial Bill Extending Damages Under Washingtons Consumer Protection Act Dies in Senate Committee The Senate Consumer Protection and Housing Committee effectively killed SB 5815 on Friday, February 23 when it failed to bring the measure to a vote. All further hearings of the committee that were scheduled to take place prior to the February 28 cut-off have been cancelled. The controversial bill would have allowed damages of up to $50,000 for each violation of the Consumer Protection Act. The bill was opposed by a broad coalition of business groups, insurers, defense lawyers, and others. Agreement on Amended Version of OIC Market Analysis Bill Agreement appears to have been reached between the OIC and insurance industry representatives with respect to amendments on SB 5717 and HB 1532the OICs Market Analysis proposal. The proposal is intended to provide the OIC with the information and methods necessary to monitor the states insurance marketplace, identify trends, changes and emerging issues to target insurers for regulatory intervention and to allocate resources where they can be most effective to protect consumers. Insurance Commissioner Mike Kreidler testified that the plan is intended to modernize the current process for market conduct examinations. The national insurance trade associations expressed concern that the bill as introduce by the OIC does not provide sufficient opportunity for insurers to verify the accuracy of the data used in the market analysis program. Concerns were also raised about the overlap of existing market conduct examination provisions and the new market analysis proposal; the lack of controls on fees charged by independent examiners under contracts with the OIC; and the lack of alternative dispute resolution provisions to address concerns that arise during the investigation or examination process. Agreement appears to have been reached on a series of amendments prepared by the OIC in response to these issues. The OIC also agreed to a series of additional technical amendments offered by insurers. Insurers have also maintained that strong confidentiality language is a priority. It now appears that measures in both the House and Senate will move with the agreed amendments. Controversial Measure Regarding Bad Faith Claims Against Insurers Remains in Senate Rules CommitteeHouse Committee to Consider House Version of the Bill SB 5726 remains in the Senate Rules Committee in preparation for possible consideration on the Senate floor in coming weeks. The controversial bill was drafted by the Washington State Trial Lawyers Association. As introduced, the bill and its counterpart in the House (HB 1491) was drafted to allow "third party bad faith" claims against insurerssimilar to the measure that was overturned by voters in California. WSTLAs bill, however, would appear to apply to first party claims as well. An amendment was adopted by the Senate Consumer Protection & Housing Committee making it clear that the measure would apply to first party bad faith claims only. The bill would allow a court to award treble damages if it is found that the insurer violated a provision of the Washington Administrative Code and that the violation was negligent or unreasonable. The Washington Defense Trial Lawyers, together with representatives of the insurance industry, spoke in opposition to the measure when it was heard by the committee. Within the next few days, the House version of the billHB 1491is likely to be brought to a vote in the House Insurance, Financial Services & Consumer Protection Committee. Controversial Bill to Criminalize Fraudulent Denial of an Insurance Claim Remains in Senate Rules Committee SB 5344 remains in the Senate Rules Committee following approval last week by the Senate Consumer Protection & Housing Committee. The controversial measure would impose criminal penalties for an insurer that fraudulently refuses to pay an insurance claim. The bill amends an existing section of law that imposes criminal penalties on policyholders who make fraudulent insurance claims. Insurers and the Washington Defense Trial Lawyers testified in opposition to the bill when it was heard by the Senate committee, arguing that the Office of the Insurance Commissioner maintains sweeping authority to protect consumers, and that significant civil remedies are also available. Insurers have objected to any suggestion that those who routinely process insurance claims should be subject to criminal scrutiny for their decisions. House Committee Schedules Vote on Controversial Wrongful Death Bill Senate Version May Lack Sufficient Support in Committee for Passage The House Judiciary Committee has scheduled HB 1873 for a possible vote on Monday, February 26. The measure would likely increase the number of claimants and value of wrongful death cases. SB 5816the Senate version of the measuremay be bogged down in committee with insufficient support for passage, and has not been scheduled for a vote. The measures have been introduced at the request of the Washington State Trial Lawyers Association. The Liability Reform Coalition, the Washington Defense Trial Lawyers, the Washington State Office of the Attorney General, the Washington State Association of Cities, the Washington State Medical Association and the Washington State Medical Association testified in opposition to the measures, expressing concern about the adverse impact that the proposals would have for defendants in wrongful death cases.
