The bill is an amended version of Governor Gregoires proposed legislation resulting from the work of the Blue Ribbon Commission on Health Care Costs and Access. The bill is scheduled for hearing on Monday, March 19. Business groups, together with health plans and the health underwriters, are prepared to testify in support of the bill. Of particular interest is an amendment that was adopted by the Senate that would allow health plans to offer an economy plan to small employers that would be free of most mandated health benefits. The amendment would also relax certain aspects of the community rating laws that currently apply. Additionally, the bill requires the Health Care Authority to design a health insurance connector through which coverage could be bought and sold efficiently. It also asks the Office of the Insurance Commissioner to prepare recommendations to reduce administrative costs. Cody-Hinkle Amendment to HB 1569 Scheduled for Hearing in Senate Committee The Senate Health & Long Term Care Committee has scheduled a hearing to consider the House-passed version of HB 1569Rep. Eileen Codys controversial proposal to implement a connector-style health system for the small group market. The hearing will take place on Monday, March 19. The amended bill resulted from efforts by Rep. Cody and Rep. Bill Hinkle to find common ground. Opposition from business groups, however, undermined support for the measure. Business groups will be circulating a redrafted letter expressing opposition to HB 1569. A similar letter was circulated in the House prior to the House vote on the measure. Most observers expect that the bill will not move forward in its current form. House Committee Schedules Hearing to Consider OIC Proposal to Overhaul the Individual Health Insurance Market The House Health Care & Wellness Committee has scheduled a hearing to consider the Senate-passed legislation proposed by Insurance Commissioner Mike Kreidler to overhaul the regulation of the individual health insurance market. As passed by the Senate, the bill would allow the OIC to disapprove rate filings in the individual market, and would raise the minimum loss ratio requirements to 75%. The Senate removed provisions from the OICs bill that would have allowed for the consideration of carrier surplus when reviewing rates. The hearing on the measure is scheduled for Monday, March 19. House Committee to Consider Controversial Retainer Health Care Practice Bill The House Health Care & Wellness Committee has scheduled a hearing to consider E2SSB 5958a bill that would exempt relating to so-called retainer health care practices from virtually all insurance requirements. A related bill, SB 5716 that was introduced by Insurance Commissioner Mike Kreidler to address the regulatory issues of concern to the OIC, was killed in the Senate Rules Committee when it was not brought to the Senate floor for a vote. The OIC has indicated that it will support E2SSB 5958 when it is considered in the House. Senate Passes Bill Allowing Punitive Damages for First Party Bad Faith ClaimsHouse Version of the Bill Killed in House Rules Committee An amended version of SB 5726 was passed by the Senate on Wednesday, March 14. The bill was approved on a final vote of 30-17 with two members excused. Although a proposed amendment was offered to remove treble damages from the bill, the amendment was defeated. Thus, the bill now goes to the House as a measure that would allow policyholders to file bad faith claims against their own insurers for up to treble damages. The bill does not allow third party bad faith claims. The bill now goes to the House, where it has been referred to the Insurance, Financial Services & Consumer Protection Committee. It will likely be scheduled for hearing next week. Representatives of the insurance industry, together with the Washington Defense Trial Lawyers and others, are mounting a strong defense. The House version of the billHB 1491was killed in the House Rules Committee when it was not be brought to the House floor for a vote. Controversial Bill to Criminalize Fraudulent Denial of an Insurance Claim Killed in Senate Rules Committee SB 5344 has been killed in the Senate Rules Committee. The controversial measure would have imposed criminal penalties for an insurer that fraudulently refuses to pay an insurance claim. Insurers and the Washington Defense Trial Lawyers testified in opposition to the bill when it was heard by the Senate committee, arguing that the Office of the Insurance Commissioner maintains sweeping authority to protect consumers, and that significant civil remedies are also available. Insurers have objected to any suggestion that those who routinely process insurance claims should be subject to criminal scrutiny for their decisions. House Passes Amended Version of Controversial Wrongful Death BillSenate Version Killed in Committee On Wednesday, March 14 the House passed an amended version of HB1873 on a final vote of 64-32 with two members excused. The measure was amended on the floor to provide a cause of action for a parent relating to the death of a child where the parent has "regularly contributed to the support of" the child under the age of 26 or who is developmentally disabled. The amended bill also provides for the recovery of non-economic damages personal to the decedent, including loss of enjoyment of life and shortened life expectancy. The survival statute also contains the same provision allowing the jury to award non-economic damages personal to the decedent, including the loss of enjoyment of life and shortened life expectancy. The amended bill has been referred to the Senate Judiciary Committee, but has not yet been scheduled for a hearing. SB 5816the Senate version of the measurewas killed in committee when it was not scheduled for a vote. House Committee Approves Senate-Passed OIC Producer Licensing BillHouse Version Killed in House Rules Committee The House Insurance, Financial Services & Consumer Protection Committee has given approval to ESSB 5715legislation that the OIC has introduced to reform and modernize agent, broker, and adjuster licensing and administration. The amended bill passed the Senate on March 7 on a final vote of 47-0 with two excused. The proposal is intended to simplify and streamline the licensing process in an effort to provide reciprocity and uniformity with other states insurance licensing laws. The bill moved forward after an agreement was reached regarding the disclosure of producer compensation. The House version of the billHB 1533was killed in the House Rules Committee when it was not brought to a vote. House Committee Approves Senate-Passed OIC Market Analysis Bill The House Insurance, Financial Services & Consumer Protection Committee has passed ESSB 5717the OICs Market Analysis proposal. The proposal is intended to provide the OIC with the information and methods necessary to monitor the states insurance marketplace, identify trends, changes and emerging issues to target insurers for regulatory intervention and to allocate resources where they can be most effective to protect consumers. The measure passed the Senate on March 7. Passage came after agreement was reached on a series of amendments prepared by the OIC in response to issues raised by the insurance industry.
