The bill was approved on a final vote of 59-38 with one member excused. Controversy punctuated heated debate on the measure. Rep. Dan Roach (R, Auburn) caused the House to grind to a halt when he made a personal reference to the spouse of Majority Leader Lynn Kessler (D, Hoquiam), who is a well-known plaintiff lawyer. Action on the bill was halted for 15 minutes as leaders worked to restore order. Rep. Roach apologized for the remark, but there was no further debate on the measure, and it was taken directly to a final vote. Tempers remained heated between Republican and Democratic leaders for the remainder of the day, and tensions are still apparent. Although a proposed amendment was offered to remove treble damages from the bill, the amendment was defeated. Also defeated was a proposal to require proof of malicious intent for bad faith actions that seek punitive damagesa standard that is common in most states that allow punitive damages in first party bad faith actions against insurers. The House adopted two amendments, however. One amendment would exempt certain health plans from bad faith actions under the bill, although the exemption does not apply to the following: -Long term care products; -Medicare Supplement Insurance; -Disability income coverage; -Accident only coverage; -Specified disease and hospital confinement indemnity coverage; -Dental only and vision only coverage; -Student coverage and other short term limited purpose or duration coverage. The other adopted amendment would require that notice of bad faith claims involving punitive damages must be filed with the Office of the Insurance Commissioner. The bill now goes back to the Senate for consideration of the amendments adopted in the House. It appears likely that the Senate will concur in the House amendments and send the bill on the Governor Gregoire. Attention will now be focused on Governor Gregoire. Efforts will be made to argue that the bill should be vetoed because it does not require proof of malice for bad faith actions that seek punitive damages. House Prepares to Consider Governor Gregoires Blue Ribbon Commission Health Care ProposalEmployer Groups Outline Support for Senate-passed Version The House is preparing to consider E2SSB 5930Governor Gregoires proposed legislation resulting from the work of the Blue Ribbon Commission on Health Care Costs and Access. Controversy swirls around the bill, however, as chiropractors and other groups have criticized provisions included in the bill when it passed the Senate. Business groups, together with health plans and the health underwriters testified in support of the bill. Of particular interest is an amendment that was adopted by the Senate that would allow health plans to offer an economy plan to small employers that would be free of most mandated health benefits. The amendment would also relax certain aspects of the community rating laws that currently apply. Additionally, the bill requires the Health Care Authority to design a health insurance connector through which coverage could be bought and sold efficiently. It also asks the Office of the Insurance Commissioner to prepare recommendations to reduce administrative costs. Chiropractor groups, together with other alternative provider representatives, oppose the billexpressing concern that the bill would allow a small employer plan to be sold without complying with all existing mandated benefits, including Washingtons every category of provider requirement. Employer groups met with Governor Gregoire to discuss the issue on Friday, April 6. Governor Gregoire confirmed her continued support for the bill, including the economy plan option supported by employers. The Governor indicated, however, that she is not yet prepared to endorse the rating reforms included in the Senate amendment. She encouraged employer groups to make efforts to build support among House Democrats, and that she would continue to work with Speaker Chopp and other House leaders in an effort to keep the issue on the table. E2SHB 1569 Advances to Senate Floor Calendar The Senate has advanced an amended version of E2SHB 1569 to the Senate floor calendar for possible consideration. Although the bill passed the House as Rep. Eileen Codys controversial proposal to implement a connector-style health system for the small group market, it was amended in the Senate Health & Long Term Care Committee to restructure the SEHIP program for small employers. Most observers believe that the bill is a placeholder as Rep. Cody, Senator Keiser and others continue to negotiate. Opposition from business groups, however, continues to undermine support for the measure. Business groups circulated a redrafted letter expressing opposition to HB 1569. OIC Proposal to Overhaul the Individual Health Insurance Market Remains in House Rules Committee The House Rules Committee continues to hold legislation proposed by Insurance Commissioner Mike Kreidler to overhaul the regulation of the individual health insurance market. As passed by the Senate, the bill would allow the OIC to disapprove rate filings in the individual market, and would raise the minimum loss ratio requirements to 75%. The Senate removed provisions from the OICs bill that would have allowed for the consideration of carrier surplus when reviewing rates. The bill must be pulled to the House floor calendar and passed by Friday, April 13 or it will be dead for this year. House Prepares to Consider Controversial Retainer Health Care Practice Bill The House is preparing to consider E2SSB 5958a bill that would exempt relating to so-called retainer health care practices from virtually all insurance requirements. The bill was placed on the House floor calendar, and could be brought to a vote at any time. A related bill, SB 5716 that was introduced by Insurance Commissioner Mike Kreidler to address the regulatory issues of concern to the OIC, was killed in the Senate Rules Committee when it was not brought to the Senate floor for a vote. The OIC testified in support E2SSB 5958. Senate Committee Kills Controversial Wrongful Death Bill On Friday, March 30, the Senate Judiciary Committee killed a controversial measure that was intended to overturn two State Supreme Court decisions relating to wrongful death cases. The bill was killed when it was not provided with a sufficient number of signatures from committee members on the majority report. With eight members on the committee, at least five signatures are necessary on the paperwork for each measure successfully referred out of committee. The paperwork on ESHB 1873 only shows four signatures. As passed by the House, the measure would provide a cause of action for a parent relating to the death of a child where the parent has "regularly contributed to the support of" the child under the age of 26 or who is developmentally disabled. The bill would also provide for the recovery of non-economic damages personal to the decedent, including loss of enjoyment of life and shortened life expectancy. The survival statute also contains the same provision allowing the jury to award non-economic damages personal to the decedent, including the loss of enjoyment of life and shortened life expectancy. Although the bill is dead in committee, those opposed to the measure will be watching for any procedural effort to remove the measure directly to the Senate floor. House Approves Senate-Passed OIC Producer Licensing Bill The House has given approval to ESSB 5715legislation that the OIC introduced to reform and modernize agent, broker, and adjuster licensing and administration. The amended bill passed the Senate on March 7 on a final vote of 47-0 with two excused. The proposal is intended to simplify and streamline the licensing process in an effort to provide reciprocity and uniformity with other states insurance licensing laws. The bill moved forward after an agreement was reached regarding the disclosure of producer compensation. The bill now goes to Governor Gregoire. House Approves Senate-Passed OIC Market Analysis Bill The House has passed ESSB 5717the OICs Market Analysis proposal. The proposal is intended to provide the OIC with the information and methods necessary to monitor the states insurance marketplace, identify trends, changes and emerging issues to target insurers for regulatory intervention and to allocate resources where they can be most effective to protect consumers. The bill passed the House with only one dissenting vote. The measure passed the Senate on March 7.
