The vote in the Senate was 31-18. The bill now goes to Governor Gregoire. The House adopted two amendments that remain in the bill as it now goes to the Governor. One amendment would exempt certain health plans from bad faith actions under the bill, although the exemption does not apply to the following: -Long term care products; -Medicare Supplement Insurance; -Disability income coverage; -Accident only coverage; -Specified disease and hospital confinement indemnity coverage; -Dental only and vision only coverage; -Student coverage and other short term limited purpose or duration coverage. The other adopted amendment would require that notice of bad faith claims involving punitive damages must be filed with the Office of the Insurance Commissioner. Insurers, national insurance trade associations, agent and broker groups, and prominent business leaders will be meeting with the Governor or writing to her arguing that the bill should be vetoed because it does not require proof of malice for bad faith actions that seek punitive damagesa standard that prevails in most other states that allow punitive damages in bad faith actions against insurers. House Rejects Employer Support for Senate-Passed Version of Governor Gregoires Blue Ribbon Commission Health Care ProposalAlternative Amendment Adopted Despite Employer Opposition The House rejected employer support for the Senate-passed version of E2SSB 5930Governor Gregoires proposed legislation resulting from the work of the Blue Ribbon Commission on Health Care Costs and Access. Instead, the House pushed through a controversial striking amendment that includes a wide array of issues, but does not provide for a flexible benefit plan option for small employers. Chiropractors and other groups have criticized provisions included in the bill when it passed the Senate. Business groups, together with health plans and the health underwriters testified in support of the Senate-passed bill. Of particular interest is an amendment that was adopted by the Senate that would allow health plans to offer an economy plan to small employers that would be free of most mandated health benefits. The amendment would also relax certain aspects of the community rating laws that currently apply. Chiropractor groups, together with other alternative provider representatives, opposed the Senate-passed billexpressing concern that the bill would allow a small employer plan to be sold without complying with all existing mandated benefits, including Washingtons every category of provider requirement. Employer groups met with Governor Gregoire to discuss the issue on Friday, April 6. Governor Gregoire confirmed her continued support for the bill, including the economy plan option supported by employers. The Governor indicated, however, that she is not yet prepared to endorse the rating reforms included in the Senate amendment. She encouraged employer groups to make efforts to build support among House Democrats, and that she would continue to work with Speaker Chopp and other House leaders in an effort to keep the issue on the table. Employer groups, together with the Washington Association of Health Underwriters and others, have requested leaders in the Senate to reject the House amendments to the bill. They have also asked Governor Gregoire to take an active role in supporting the provisions allowing for a flexible benefit option for small employers. With only a week remaining in the 2007 legislative session, significant decisions remain to be made. Senate Passes Amended Version of E2SHB 1569Bill Goes Back to the House for Consideration of the Senate Amendments The Senate has approved an amended version of E2SHB 1569sweeping aside the concerns of the business community relating to the measure. Although the bill passed the House as Rep. Eileen Codys controversial proposal to implement a connector-style health system for the small group market, it was amended in the Senate Health & Long Term Care Committee to restructure the SEHIP program for small employers. A striking amendment offered by Senator Karen Keiser (D, Kent) was adopted on the Senate floor. The amendment appears to maintain the SEHIP program under the direction of the HCA. The amendment also establishes a new board that would be directed to evaluate whether the entire individual and small group markets should be included within the program. The amended bill goes back to the House for consideration of the Senate amendments. House Kills OIC Proposal to Overhaul the Individual Health Insurance Market The House has killed legislation proposed by Insurance Commissioner Mike Kreidler to overhaul the regulation of the individual health insurance market. The measure was killed on Friday, April 13 when it was not brought to a vote on the House floor prior to the cutoff for action. As passed by the Senate, the bill would have allowed the OIC to disapprove rate filings in the individual market, and would have raised the minimum loss ratio requirements to 75%. Senate Concurs with House Amendments to Chiropractic Contracting Bill Controversial Measure Goes to Governor Gregoire On Saturday, April 14 the Washington State Senate concurred in the House amendments to SB 5597sending the measure on the Governor Gregoire. The Senate concurrence vote was 41-6 with two excused. Despite opposition from health plans, employers, and the Health Care Authority, the measure was approved by the House on a vote of 84-10 with four excused. Critics have argued that the bill will increase costs by requiring provider networks to be larger than necessary. The bill would require health plans to contract with all contractors in a chiropractic clinic, even if the provider network is adequate to meet patient needs. Senate to Consider House Amendments to Controversial Retainer Health Care Practice Bill The Senate will consider House amendments to E2SSB 5958a bill that would exempt relating to so-called retainer health care practices from virtually all insurance requirements. A related bill, SB 5716 that was introduced by Insurance Commissioner Mike Kreidler to address the regulatory issues of concern to the OIC, was killed in the Senate Rules Committee when it was not brought to the Senate floor for a vote. The OIC testified in support E2SSB 5958. Governor to Take Action on OIC Producer Licensing Bill This week Governor Gregoire will take action on ESSB 5715legislation that the OIC introduced to reform and modernize agent, broker, and adjuster licensing and administration. The proposal is intended to simplify and streamline the licensing process in an effort to provide reciprocity and uniformity with other states insurance licensing laws. The bill moved forward after an agreement was reached regarding the disclosure of producer compensation. Governor to Take Action on OIC Market Analysis Bill The House and Senate have passed ESSB 5717the OICs Market Analysis proposal. Governor Gregoire is expected to sign the bill within the next few days. The proposal is intended to provide the OIC with the information and methods necessary to monitor the states insurance marketplace, identify trends, changes and emerging issues to target insurers for regulatory intervention and to allocate resources where they can be most effective to protect consumers.
