Except for fiscal committees, Friday, February 8 was the last day for committees in the House and Senate to give approval to bills in the House of origin. Hundreds of bills were left behind at the cut-off when they were not brought to a vote before the deadline. Fiscal committees have until Tuesday, February 12 to give approval to measures that pose a fiscal impact for the state. Dozens of bills are stacked up waiting for consideration before the fiscal committees in the next few days. Schedules have been compressed more than usual because the fiscal committees will not be meeting over the weekend due to the Presidential Caucuses that are scheduled for Saturday, February 9. This will put added pressure on the committees on Monday and Tuesday as key measures are prioritized for consideration. Many measures will likely be left behind. House Committee Approves OIC Individual Market Bill The House Health Care & Wellness Committee has passed ESB 5261the OICs proposal relating to the individual health insurance market. The committee passed the measure only two days after considering during an evening hearing on Tuesday, February 5. The vote was 8-5, with all Democrats voting in support of the measure, and all Republicans with the exception of Rep. Tom Campbell (D, 2nd Legislative District) voting against it. The measure now goes to the House Rules Committee in preparation for consideration on the House floor. The bill would provide authority to the OIC to disapprove rates in the individual market. The measure would also increase the minimum loss ratio for products in the individual market to 75% (77% offset by the 2% premium tax). Pursuant to an amendment adopted in the Senate, the authority to disapprove rates would sunset on January 1, 2012. The bill also contains a provision which would establish a sliding scale minimum loss ratio based on a carriers declination ratea provision added on the Senate floor. The measure has already been approved by the Senate on a final vote of 31-18. All Democrats but one voted for the measure, all Republicans voted against it. House Appropriations Committee Approves HIP Measure The House Appropriations Committee passed HB 2537a measure that was introduced to clarify the authority and activities of the Health Insurance Partnership. The Appropriations Committee held a hearing to consider the measure for fiscal implications on Monday, February 4, and passed it two days later on February 6. The measure was previously passed by the House Health Care & Wellness Committee on a divided vote, with all Democrats voting in favor of the measure and almost all Republicans voting against it. The Washington Association of Health Underwriters, together with small business groups, testified with concerns about the billarguing that the HIP does not appear to be referenced in the budget to provide subsidies to low income employees of small employers. They also expressed concern that the legislation may allow the HIP to be preferentially positioned in the market to compete directly with current market options. Similar concerns were expressed before the House Appropriations Committee House and Senate Committees Leave Comprehensive Health Care Reform Proposals Behind Despite hearings and work sessions, House and Senate committees have declined to take action on any of the comprehensive health care reform proposals that have been introduced during the 2008 session. As a consequence, SB 6221 (Sen. Keisers Wisconsin proposal), SB 6574 (Sen. Pflugs Exchange proposal), and SB 6603/HB 2640 (Insurance Commissioner Kreidlers Guaranteed Benefit Program Trust proposal) have all been killed when they were not approved by the February 8 cut-off for committee approval. Comprehensive reform proposals will clearly be discussed during the campaign season in anticipation of the 2009 legislative session. Senate Committee Approves Study of Interpreter Services The Senate Health & Long Term Care Committee has approved a measure authorizing a study of language access problems encountered by consumers who purchase health insurance. The study would be conducted by the Office of the Insurance Commissioner, with recommendations due by January 1, 2009. The study is all that remains of SB 6684a measure that was introduced as a proposal to require health insurers to provide language translators to assist non-English-speaking consumers communicate with health care providers. At a hearing on the measure, AHIP and the Washington Association of Health Underwriters testified with concerns about the costs and operational difficulties posed by the bill. When the measure was brought to a vote on Thursday, February 7, an amendment was adopted to remove all aspects of the bill except for the study. The measure has been referred to the Senate Ways and Means Committee. It has not yet been scheduled for a hearing. Senate Ways and Means Committee Approves Bill Relating to Reimbursements Paid to ChiropractorsMeasure Placed on Senate Floor Calendar The Senate Ways and Means Committee has taken action on SB 5596a measure that would prohibit health plans from setting payment formulas for chiropractors which are different from those set for other providers when they are performing health care services. AHIP and Regence previously testified against the measure, pointing out that the fiscal note on the bill suggests that the costs for chiropractic services will increase if the measure is enacted. The Ways and Means Committee adopted an amendment deleting language relating to discrimination in the underlying bill, and extending the effective date of the restrictions on reimbursement schedules by one year, until January 1, 2009. The bill has been placed on the Senate Floor Calendar, and could be brought to a vote at any time. Senate Committee Passes Controversial Bill Relating to Optometrists On Thursday, February 7, the Senate Health & Long Term Care Committee gave approval to an amended version of SB 6644a measure that would impose restrictions on referral provisions in health plans with respect to eye care. Groups representing ophthalmologists and health carriers testified in opposition to the measure when it was considered at hearing, expressing concern about the vague language in the measure, and the likelihood of new litigation directed at health plans. The bill has been referred to the Senate Rules Committee. Bills to Enact the NAIC Model on Long Term Care Insurance Move Forward The House and Senate are each preparing to consider bills based on the NAIC Model Long Term Care Act. On Wednesday, January 30 the House Health Care & Wellness Committee approved a slightly-amended version of HB 2666. The amendment calls for the OIC to adopt rules to implement the measure. The bill is ready to be placed on the House Floor Calendar, and could move forward at any time. On Friday, January 25 the Senate Health & Long Term Care Committee approved SB 6364. The measure was advanced to the Senate Floor Calendar on Wednesday, January 30 where it awaits consideration. The ACLI, together with AHIP, NAIFA, and the Washington Association of Health Underwriters testified in support of the measures. Deputy Insurance Commissioner Beth Berendt also testified in support of the bills. There was no opposition. Senate Committee Kills Bill to Allow Exemplary Damages The Senate Judiciary Committee has killed SB 6614a controversial measure that was introduced by Senator Brian Weinstein (D, Mercer Island) which would have allowed exemplary damages to be sought in civil actions in which a defendant acted with reckless and wanton disregard for the health, safety, and welfare of another. The bill was killed when it was not brought to a vote before the February 8 cut-off for committee action. The measure was a clear attempt to enact authority for unlimited punitive damages. A broad coalition of employers, professional associations, construction groups, insurers, defense lawyers, and others organized to oppose the measure. Representatives from the Washington Defense Trial Lawyers, the Washington State Medical Association, and the National Federation of Independent Business testified against the bill when it was considered on Wednesday, February 6. During the last meeting of the Judiciary Committee on Friday, February 8, Committee Chairman Adam Kline (D, Seattle) attempted to negotiate an agreement to secure the necessary votes to keep the bill alive. These efforts failed, and the bill was not brought to a vote. Bill to Increase Damages Under the Consumer Protection Act Killed in Committee The Senate Consumer Protection & Housing Committee has killed SB 6382a measure that would increase damages for violations of the Consumer Protection Act from a maximum of $10,000 to $50,000. The measure was not brought to a vote before the February 8 cut-off for committee action. Retailers, employers, defense attorneys, and insurers indicated their opposition to the measure when it was considered during a hearing on Thursday, January 31. House and Senate Committees Approve Wrongful Death Measures Despite Opposition from Local Governments and Others On Monday, February 4, the House Judiciary Committee approved an amended version of HB 1873a controversial wrongful death bill that passed in the House last year but failed in the Senate Judiciary Committee when an insufficient number of committee members failed to sign the majority report to pass the bill out of committee. The committee approved the measure following a hearing on Friday, February 1 that featured testimony from two panels of state and local government representatives who testified in opposition to the measure, arguing that the bill would add nearly $2 million to the value of each wrongful death claim that involves the state and local governments as defendants. Insurers, physician groups, hospitals, construction groups, and others have also indicated opposition to the measure. The amended bill was referred to the House Appropriations Committee where it was considered on Friday, February 8. A panel of local government representatives again testified in opposition to the measure. It is scheduled for a vote in the Appropriations Committee on Monday, February 11. The issue is also under consideration in the Senate. SB 6696 was introduced by Sen. Darlene Fairley (D, 32nd Legislative District), and Chair of the Senate Government Operations & Elections Committee. Local government representatives, together with the Washington State Medical Association and the Washington Defense Trial Lawyers testified in opposition to the measure at a hearing on Tuesday, February 5.
