The cut-off resolution calls for bills in the house of origin to be approved by Thursday, March 12 at 5:00 p.m. With rare exception, bills failing to be approved by the cut-off dates will not be considered further this session. House Committee Approves Bill to Force School Districts and ESDs to Purchase Health Benefits though the PEBBSenate Committee Votes to Study the Issue The House Ways and Means Committee approved a slightly-amended version of HB 1940 on Monday, March 2. The measure would compel school districts and ESDs to purchase health benefits through the state after September 1, 2012. When the bill was considered at hearing, WAHU, together with representatives of the Washington Education Association, other union groups, and some school districts, testified in opposition to the bill, arguing that school districts and ESDs should continue to have the choice of participating in PEBB programs or finding other options to serve their needs. The bill remains in the House Rules Committee, and will be dead if it is not moved to the House floor calendar and approved by the March 12 deadline. The Senate Ways and Means Committee amended a related billSB 5491on Monday, March 2. The amendment adopted in the Ways and Means Committee replaced all of the original language of the bill with a study of the issue to be conducted by the Health Care Authority. The amended bill has been moved to the Senate floor calendar for consideration. Senate Ways and Means Committee Considers Scaled-Back Reform Proposal On Monday, March 2 the Senate Ways and Means Committee passed SB 5945a bill that was introduced by Senator Karen Keiser to provide universal coverage to all Washington residents by 2012. The measure was previously amended in the Senate Health & Long Term Care Committee to establish a Washington Health Partnership as a working group to focus on health care reform goals in phases. These phases include extending coverage to individuals below 200% of the federal poverty level in an Apple Health program for adults, consolidating the purchase of health coverage, and streamlining administration. The Partnership would also examine health care reform proposals. Under an amendment adopted by the Senate Ways and Means Committee, the Partnership would be required to seek to maximize federal funds for vaccines for low income children and family planning services. The amendment calls for the Partnership to determine if additional federal funds are available to provide funding for vaccines for non-Medicaid eligible children under 300% of the federal poverty level. The bill has been referred to the Senate Rules Committee, and must be brought to the Senate floor and approved prior to the March 12 cut-off if it is to survive. Bill on Organ Transplant Passes Senate On Wednesday, March 4 the Senate took action and passed SB 5725. The measure was passed without a dissenting vote. Although the bill was introduced to prohibit health plans from imposing separate lifetime limits on benefits for organ transplants, an amendment adopted by the Senate Health and Long Term Care Committee allows separate lifetime limits, but provides that such limits can not be lower than $350,000. The fiscal note on the bill shows no cost to the state because the programs administered by the Health Care Authority do not currently have separate limits on organ transplant benefits. The measure now goes to the House Health Care & Wellness Committee for consideration. Measure to Increase Coverage for Neurodevelopmental Therapies Scheduled Killed in House Ways and Means Committee The House Ways and Means Committee has killed HB 1412a measure that would have amended the current mandated benefit for neurodevelopmental therapies by extending the age for those eligible for services to 18. The bill was referred to the committee for consideration of a $1.9 million fiscal note relating to costs that the measure would pose for the state, and it appears that budget writers were not prepared to fund the costs of the measure in the budget. The measure was previously approved by the House Health Care & Wellness Committee. The bill would have directed the Department of Health to determine the most appropriate means to regulate providers who use applied behavioral analysis for the treatment of autism, and identify therapies that should be considered to be in accordance with generally accepted standards of practice. The measure was introduced as an alternate proposal to the bills that would specifically mandate coverage for autism services. When the bill was heard by the House Health Care & Wellness Committee, health plan representatives expressed appreciation to the bills sponsor for working to find measured ways to improve coverage and benefits for neurodevelopmental services. The Senate Health & Long Term Care Committee killed a sweeping measure (SB 5203) that would have mandated costly and controversial services with respect to autism. The bill was killed when it was not brought to a vote in committee before the cut-off for passageperhaps because its fiscal note exceeds $16 million for the 2009-11 biennium. The House Health Care & Wellness Committee previously killed HB 1210the House counterpart to SB 5203when it was not considered at hearing and approved prior to the February 20 cut-off date for House committee action. Senate Approves Bill to Expand Retainer Medicine Plans The Senate has approved SSB 5436a measure that would allow retainer medicine plans to expand services that are currently allowed. Under the bill, direct practices furnishing primary care would be allowed to pay for charges associated with routine lab and imaging services. The bill would also partially lift restrictions on direct practices from accepting payments for services from insurers. The measure further provides that direct practices would be allowed to accept payments from self-insured plans, and would allow direct practices to accept payment of direct fees from employers. The bill was amended to require the Office of the Insurance Commissioner to work with HMOs to determine how they might operate as a direct practice plan. AHIP and other health plan representatives testified in opposition to the measure when it was considered at hearingarguing that the bill prematurely expands the authority of retainer practice plans before the first report from the OIC is due, and that such plans are not required to comply with a wide array of regulatory requirements that are imposed on health carriers. OIC Bill to Regulate Discount Plans Remains in Senate Rules Committee A proposal introduced at the request of Insurance Commissioner Mike Kreidler to regulate certain Discount Health Plans remains in the Senate Rules Committee. SB 5480 would establish consumer protection standards and new regulatory requirements with respect to health programs that market discounts on charges for health care services. The measure would require such programs to be licensed by the OIC before conducting business in the state, and current programs would have six months from the effective date of the act to submit an application and come into compliance. At the hearing on the measure, Commissioner Kreidler testified in support, indicating that consumers are frequently confused by marketing materials relating to discount programs, and that his office does not currently have regulatory authority over them. The Washington Association of Health Underwriters also testified in support of the bill, arguing that licensed agents and brokers must adhere to regulatory standards with respect to their actions, but that those who market discount programs are not subject to any standards or requirements, and that consumers can easily become confused about what is being sold. The bill will be dead for the session if it is not pulled to the Senate floor and passed before the March 12 cut-off.
