The Senate proposal includes budget cuts of $3.8 billion, with more than $1.3 billion of that amount coming out of public schools and higher education. The House proposal cuts nearly $4 billion, with even larger cuts to higher education than seen in the Senate plan. Both bills would reduce health care programsslicing enrollment in the Washington Basic Health Plan by 43%. Additional cuts in budgets directed at state employees, public safety, human services, and state parks are also common to both proposals. Both plans include the use of more than $3 billion in federal economic stimulus funds. Budget negotiators are working to close the differences between the Senate and House proposals. With a budget shortfall approaching $9 billion, there is an active debate within the House and Senate Democratic caucuses about new tax proposals. The details have not yet been released, but speculation is growing that a proposal to increase taxes will be put to voters sometime this year. Business groups argue that taxes should not be increased while the states economy continues in recession. Current public opinion surveys suggest that significant tax increases will likely be a tough sell with the voters. House Ways & Means Committee Considers Controversial Bill Regarding Coordination of Benefits to Assure that Medicaid is Secondary to Other Health Coverage HB 2330 was introduced on April 1, 2009, and was immediately scheduled for hearing before the House Ways & Means Committee on Saturday, April 4. The bill is intended to facilitate the ability of the Department of Social and Health Services to obtain information from health carriers about eligibility for coverage regarding individuals who are also eligible for Medicaid. The bill imposes strict standards for carriers to provide information to DSHS within 24 hours of receiving inquiries from DSHS regarding coverage. The measure would impose damages of up to $1000 for each failure to respond to such inquiries. Additionally, the measure would allow DSHS to contract with an agent to assist with these functions. DSHS, AHIP, Regence BlueShield, and Premera Blue Cross all testified in opposition to the measure. There was no testimony in support. The committee was advised that DSHS currently maintains close contact with health carriers with respect to coordination of benefits, and that the HB 2330 would likely add costs and complexities to the current relationship. AHIP expressed opposition to provisions in the bill allowing DSHS to use a private vendor to demand data from carriers. Copies of state letters terminating vendor contracts in Arkansas and Kansas were provided to the committee. AHIP also testified in opposition to the punitive damages contained in the measure. The bill has not been scheduled for a vote by the committee. House Ways and Means Committee Considers Amended Bill on Coverage for School Districts and Educational Service Districts On Saturday, April 4 the House Ways and Means Committee held a hearing to consider 2SSB 5491a measure that was introduced to require school districts and ESDs to participate in health plans offered by the Public Employees Benefits Board, but which was amended in the Senate to merely study the issue. WAHU, together with the Washington Education Association and others testified in opposition to the measure, noting that studies have already confirmed that the state would not achieve any savings from the proposal. Testimony also recommended that if the study bill goes forward, a licensed insurance producer should be included as a participant on the study. In a surprise move, Rep. Barbara Bailey (R, Whidbey Island) and Rep. Eileen Cody (D, Seattle) introduced a new striking amendment before the committee. This amendment replaces all of the language in the Senate-passed study with new language also calling for a study of the issue. The amendment remains objectionable because is presumes an outcome to the study, and clearly indicates that the ultimate course is to bring school districts and ESD's into the PEBB. The new Bailey/Cody amendment removes the specific references to various groups that would have participated in the study. The amendment would require health carriers and self-insured plan administrators to submit information about their K-12 health plans to the HCA, and for the HCA to prepare a report with recommendations to the legislature. The House Ways and Means Committee approved the new Bailey/Cody amendment, and referred the bill to the House Rules Committee with a do pass recommendation. House Committee Approves Scaled-back Reform Proposal The House Health & Human Services Appropriations Committee has approved an amended version of 2SSB 5945a bill that was introduced by Senator Karen Keiser to provide universal coverage to all Washington residents by 2012. The measure was previously amended and approved by the Senate to establish a Washington Health Partnership as a working group to focus on health care reform goals in phases. These phases include extending coverage to individuals below 200% of the federal poverty level in an Apple Health program for adults, consolidating the purchase of health coverage, and streamlining administration. The Partnership would also examine health care reform proposals. Under the measure passed by the Senate, the Partnership would be required to seek to maximize federal funds for vaccines for low income children and family planning services. The bill also calls for the Partnership to determine if additional federal funds are available to provide funding for vaccines for non-Medicaid eligible children under 300% of the federal poverty level. The amended bill carries a fiscal note of nearly $625,000 for the next biennium. Business groups expressed opposition to the measure, arguing that the Medicaid provisions in the measure would commit the state to future financial obligations even if the additional federal funding becomes unavailable, and that the proposal contemplates billions of dollars in new payroll taxes if it becomes fully implemented. The bill now goes to the House Rules Committee. House Committee Approves OIC Bill to Regulate Discount Plans A proposal introduced at the request of Insurance Commissioner Mike Kreidler to regulate certain Discount Health Plans has been approved by the House General Government Appropriations Committee. The measure has already been passed by the Senate, and has been approved by the House Health Care & Wellness Committee. SSB 5480 would establish consumer protection standards and new regulatory requirements with respect to health programs that market discounts on charges for health care services. The measure would require such programs to be licensed by the OIC before conducting business in the state, and current programs would have six months from the effective date of the act to submit an application and come into compliance. The hearing on the measure, the OIC testified in support, indicating that consumers are frequently confused by marketing materials relating to discount programs, and that his office does not currently have regulatory authority over them. The Washington Association of Health Underwriters also testified in support of the bill, arguing that licensed agents and brokers must adhere to regulatory standards with respect to their actions, but that those who market discount programs are not subject to any standards or requirements, and that consumers can easily become confused about what is being sold. The bill will go to the House Rules Committee in preparation for consideration on the House floor. Senate Approves House-Passed Measure Relating to the Individual Market Standard Health QuestionnaireBill Goes to Governor Gregoire The full Senate has approved ESHB 1401a measure that would allow individuals who are eligible to purchase COBRA coverage, or who drop COBRA coverage, to be exempt from the standard health questionnaire when they apply for individual health insurance coverage. The bill has already been approved by the House, and has been delivered to Governor Gregoire for consideration. There was no testimony in opposition to the measure when it was considered at hearing in the House and Senate. Governor Gregoire is expected to sign the bill within the next few days. Study on Association Health Plans Appears in House Budget Proviso Although the House killed SHB 1714a controversial measure relating to association group plansthe issue has been addressed in a budget proviso included in the House budget proposal. SHB 1714 was killed when it was not brought to a vote on the House floor prior to the cut-off for approval on Thursday, March 12. The measure was the subject of significant negotiations between business groups, the OIC, and key legislators. The issue remains alive, however, as key legislators prepared a budget proviso calling for data on association health plans to be provided to the Office of the Insurance Commissioner to facilitate a better understanding of the association health plan market. In an effort to limit the scope and use of the data to be provided to the OIC, association groups have negotiated the language of the budget proviso with the Office of the Insurance Commissioner and key legislators. House Ways and Means Committee Considers Bill on Administrative Simplification and Streamlining The House Ways & Means Committee held a hearing on Saturday, April 4 to consider 2SSB 5346a measure that is intended to establish streamlined and uniform standards for the administration of private and public health care programs. The measure has already been approved by the Senate as well as the House Health Care & Wellness Committee. The Forum, together with the Washington State Medical Association and AARP testified in support of the measure. At hearings in the Senate and before the House Health Care & Wellness Committee, AHIP urged the committee to continue to include state programs within the requirements of the measure. The bill directs the Insurance Commissioner to designate one or more lead organizations to coordinate the development of processes, guidelines, and standards to streamline health care administration for use by payers and providers of health care services in Washington State. The bill also directs the Department of Social and Health Services, the Department of Labor and Industries, and the Health Care Authority to cooperate in this process. The bill appears likely to be approved by House Ways and Means Committee, which is considering the measures $1.4 million fiscal note.
